In a Chapter 7 bankruptcy, people go through an asset liquidation proceeding. They can often claim certain exemptions to protect their assets. If you have a Homestead Declaration in place under Massachusetts state law, you may actually be able to retain a much greater portion of the money from a liquidation sale of your home than you would normally be allowed to keep under federal bankruptcy law. In a Chapter 13 bankruptcy, having a Homestead Declaration in place may decrease the amount of money you have to pay through your Chapter 13 payment plan proposal.
